Baltimore’s top prosecutor is no longer seeking to vacate the murder conviction of Adnan Syed, the man whose case garnered national attention in the “Serial” podcast over a decade ago.

The Baltimore City state’s attorney’s office withdrew its motion to toss out the murder conviction of “Serial” subject Adnan Syed, according to a memorandum filed Tuesday evening. But prosecutors will not seek to have him sent back to prison.

Adnan Syed, whose murder case was chronicled in the "Serial" podcast in 2014, returns to a Baltimore courtroom Wednesday as a judge considers whether to reduce his sentence under the Juvenile Restoration Act.

David Sanford, an attorney for Hae Min Lee’s family, asked the judge to deny Syed’s motion to reduce his sentence, reminding the court that he remains a convicted murderer and hasn’t expressed remorse or accepted responsibility for the crime.
